Terms of Service

1. Who we are

Keepsake ("Keepsake", "we", "us") operates the Keepsake service — a website and application for creating events, collecting video messages from friends and family, and assembling those messages into memory montages. These Terms of Service ("Terms") form a binding agreement between you and Keepsake. When you create an account, record or upload a video message, or otherwise use Keepsake, you agree to these Terms.

2. The service

Keepsake lets an organizer create an event, share a private link or QR code, and invite guests to record short video messages in their browser. Keepsake stores those messages for the organizer and offers AI-assisted editing tools (such as clip ordering, trimming, title cards, and background music) to help assemble a montage. Guests do not need a Keepsake account to record a message.

3. Acceptance and eligibility

By continuing to use the service you accept these Terms. You must be at least 18 years old to create an organizer account, or have permission from a parent or guardian. You agree to provide accurate information, keep it up to date, and keep your account credentials confidential. You are responsible for all activity that happens under your account.

If you use Keepsake on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

4. Acceptable use

You must not misuse Keepsake. In particular, you must not:

• use the service for any unlawful purpose;
• commit or encourage fraud, spam, or harassment;
• infringe the intellectual property or privacy rights of others;
• interfere with the security of the service — including introducing malware, probing or scanning for vulnerabilities, circumventing access limits, or scraping content.

You must only record and upload video messages of people who have consented to being recorded, and you are responsible for having that consent.

5. AI features

Keepsake includes AI-assisted editing features (the "Montage Producer") that propose and apply edits such as clip ordering, trim points, title-card text, and music choices. Additional rules apply to these features:

• Prohibited use. You must not use the AI features to create or spread illegal content, non-consensual intimate imagery, deepfakes of real people without consent, hate speech, malware, or content that attempts to jailbreak or abuse the AI system.
• Your responsibility. You are responsible for the instructions you give the AI, for how you use its suggestions and outputs, for verifying the accuracy of anything it produces, and for having the rights to the content you provide as input.
• Accuracy. AI output may be inaccurate or incomplete. It is not suitable for regulated professional advice (legal, medical, financial) without independent review, and we make no guarantee that AI-suggested edits will match your creative intent.
• Content moderation. We may remove or restrict content, refuse or filter AI outputs, and suspend accounts that repeatedly or seriously violate these rules.

6. Your content

You keep ownership of the video messages, music, text, and other content you or your guests record or upload. You grant Keepsake a limited licence to host, store, process, and display that content solely to provide the service to you — including processing it with the AI editing features at your direction.

If you believe content on Keepsake infringes your rights, send a takedown notice to mohammed.quli@gmail.com identifying the content and the basis of your complaint. We may remove content while we review. Accounts that repeatedly infringe the rights of others may be terminated.

7. Our intellectual property

Keepsake retains all right, title, and interest in the service itself — including the software, design, documentation, branding, and content we create. Nothing in these Terms transfers any of that to you.

8. Licence and restrictions

We grant you a limited, non-exclusive, non-transferable right to use Keepsake within the plan you have selected. You may not reverse engineer the service, resell or redistribute it, or circumvent its technical limits — including plan limits on the number of video messages.

9. Payment and subscription terms

Keepsake offers a free plan (up to 3 video messages in total across your events) and an Unlimited subscription at US$10 per month. Subscriptions renew monthly until cancelled. You may cancel at any time and will keep Unlimited access until the end of the period you have already paid for.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms. Refunds are described in our Refund Policy.

10. Service level

Keepsake is provided "as is". We do not guarantee that the service will be uninterrupted, error-free, or available at any particular time, and we may change or discontinue features. We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

11. Suspension and termination

We may suspend or terminate your access to Keepsake, with notice where practicable, if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the service and delete your account at any time.

If your access ends, your events and recordings become inaccessible. You will have 30 days from termination to contact us and request an export of your video messages before we delete them.

12. Limitation of liability

To the fullest extent permitted by law, Keepsake's aggregate liability to you is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for fraud, death, or personal injury.

13. Indemnity

You agree to indemnify Keepsake against claims arising from content you or your guests provide, your unlawful use of the service, or your violation of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, and the parties submit to the courts of that state, except where applicable law gives you the right to bring a claim in the courts of your own country.

15. Other terms

We may update these Terms from time to time; material changes will be notified in the app. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. If any provision is unenforceable, the rest remains in effect.
